Terms and Conditions

The Terms and Conditions detailed below apply to all photography bookings made with Jodi Davies Photography (“JDP”).

If you would like any clarification on these Terms and Conditions please don’t hesitate to contact me and I’ll be happy to help. JDP reserves the right to change these Terms and Conditions at any time.

Booking & payment

Session bookings should be confirmed in writing by email or otherwise by the Client with JDP.

To secure the session booking, a deposit of £150 is payable by the Client at the time of booking. The remaining session fee is payable at least one week in advance of the session taking place. An invoice will be provided to the Client and payments can be made by bank transfer or cash to JDP.

Payment of the deposit is taken as confirmation of the Client’s acceptance of JDP’s terms and conditions. The Client will also be asked to sign a Terms and Conditions agreement at the time of booking or on the day of the session itself.

Cancellation

If JDP needs to cancel the session, an alternative date will be offered to the Client. Where not possible, JDP’s liability shall be limited to a full refund of the deposit or the session fee, whichever has been paid to JDP by the Client.

At least 5 days’ notice is required for Client cancellations. An alternative date will be offered where possible but cannot be guaranteed. The deposit is non refundable if the client fails to attend a session without providing sufficient notice.

For photography sessions involving babies and children JDP understands that illnesses can develop suddenly. For this reason, should a session be cancelled with less than 5 days’ notice due to sickness, an alternative date will be offered where possible.

For sessions that are booked to be at an outside location, the possibility of bad weather is sometimes an issue. If the weather is so bad as to be deemed by JDP to be detrimental to the successful completion of the photoshoot, and there is no indoors alternative, then a mutually convenient date will be arranged to reschedule the session, within a four week period.

Location Portrait Session Details and Terms

JDP will end the session at their discretion when it is determined that adequate images in terms of quality and quantity have been captured.

JDP reserves the right to refuse a requested location for any reason. JDP will make every effort to comply with requests for specific photos. Please ensure these are notified in advance of the sitting.

Due to factors such as weather or willingness/co-operation of subjects, it may not be possible for all of the images requested or expected to be captured. JDP will not be held liable for any specific images not captured.

The Client is responsible for their children/pets at all sessions. No cameras or mobile cameras are allowed during a session.

Artistic Freedom

By placing a booking with JDP, it is accepted that the Client is happy with JDP’s style of photography, her approach, and the quality of the finished photographic products. JDP will retain full artistic freedom at all times, in selecting the images to be edited and in editing those photos according to JDP’s personal style and editing technique. JDP will make the final selection of images to be shared with the Client. The proofs will be professionally post-processed. JDP is granted total artistic control over the final image.

Ordering products

By placing an order with JDP, the Client is committing to buy the ordered product. Payment for items ordered must be made in full at the time of ordering. Print and product prices, which are subject to change at the discretion of JDP, are available on the web site (prices valid at the time of placing an order will be honoured).

Images not ordered (frames, albums, etc) within one month of completion will be deleted by JDP, unless the Client requests an extension in writing (a one month limit applies to all extensions). The digital files of all purchased images will be archived.

An order is fulfilled between seven days and 4 weeks from receipt of payment for goods, depending on the products ordered and photographer's workloads/commitments. JDP does not accept responsibility for any delays cause by supplier interruptions.

JDP will retain full copyright of the Raw images from the photoshoot. The Raw images will not be shared with the Client.

Force Majeure

In the unlikely event of total photographic failure, injury or sickness beyond JDP's control, their liability shall be a limited to a full refund of all monies paid. Your statutory rights are not affected.

Terms of use & copyright

It is understood JDP needs no prior consent to use or display any images taken in her portfolios, literature, exhibitions, website, social media, competitions and advertising. Permission is sought in advance of any images being used on social media and any objections are generally honoured.

No further use of the images will be made by the photographer for any other commercial reason except with the specific written permission of the client.

The client may not use, allow to be used or reproduce any of the images created by JDP during the course of a session for any commercial purpose without prior consent. Any agreed commercial use will be subject to standard market rates and billed accordingly in addition to the session costs.

Copyright of all images remains the property of the photographer. This is a standard condition for Professional Photographers. Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically/electronically or by any other means an image created by JDP without prior permission in writing.

In the case of digital purchases, JDP cannot be held responsible for the quality of print/products provided by a third party.
